OFFICIAL "MACWORLD 2010" CONTEST RULES

  1. CONTEST PERIOD: The entry period for the Macworld 2010 Contest ("Contest") will be during Macworld 2010 Expo exhibit hours on February 11 through 13, 2010, from 12:00 P.M. until 6:00 P.M. PST on Thursday and from 10:00 A.M. until 6:00 P.M. PST on Friday and Saturday ("Contest Period").
  2. ELIGIBILITY: This Contest is open to all attendees of Macworld 2010 Expo who are at least 16 years of age on the day of entry. Attendees under the age of 16 may participate in the presence of their parent or legal guardian, the parent or legal guardian being deemed the Contest entrant and potential winner. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. This Contest is subject to all applicable federal, state, and local laws and regulations and shall be construed and evaluated only according to the laws of the State of California, United States of America. Employees, officers, directors and agents (and their immediate families and household members) of Sponsor are not eligible to participate in the Contest.
  3. ENTRY: To enter, visit the MobilityWare booth in the Macworld 2010 Expo Mobile Application Showcase area (booth 1366, MA29). Provide your name and email address. Play Word Warp Xtreme Death Spiral mode on an Apple iPod touch® provided for your use at the booth. Although there may be other game modes available for play, only Death Spiral scores are eligible for this Contest. Entrants are limited to one round of Death Spiral per day.
  4. PRIZES: Upon verification of eligibility a total of ten (10) entrants will each win one of ten (10) prizes: nine (9) entrants will each win one (1) $15 iTunes® Gift Card for top daily Death Spiral scores, and one (1) entrant with the highest Death Spiral score over all three days will win one (1) Grand Prize of an Apple 8GB iPod touch®. All entrants are limited to winning one MobilityWare sponsored contest in any consecutive twelve (12) month period. The Approximate Retail Value (“ARV”) of each iTunes® Gift Card awarded is $15.00. The Approximate Retail Value (“ARV”) of the iPod touch® awarded is $199.00. The total ARV is $334.00. Prize winner is responsible for all taxes, fees and costs associated with prize receipt and/or use. Sponsor may substitute a prize of equal or greater value in the event the advertised prize(s) become unavailable. Neither Apple Inc. nor IDG World Expo are sponsors of, or associated with, this Contest in any way.
  5. AWARDING OF PRIZES: The Sponsor will select potential winners by reviewing the tabulated scores, then notify potential winners via the provided email address on or about Monday, February 15, 2010. The potential winner of the Apple 8GB iPod touch® Grand Prize will be the entrant with the highest Death Spiral score recorded among all three days. Potential winners of $15 iTunes® Gift Cards will be the entrants with the top three (3) Death Spiral scores recorded on each of the three (3) days, after the Grand Prize winning score is removed from consideration. To claim a prize, each potential winner must return to Sponsor an Affidavit of Eligibility. If a potential winner cannot be contacted and the prize validly claimed within fourteen (14) days from the first notification attempt, then that potential winner will be disqualified and another potential winner will be selected from the remaining eligible entries. In the event a second potential winner cannot be contacted and prize validly claimed within fourteen (14) days from the first notification attempt to the second individual, that prize will not be awarded for this Contest and the total ARV reduced by the ARV of that prize. In the event of a dispute as to the identity of a potential winner, the potentially winning entry will be declared made by the holder of the email account provided at the time of entry. An "email account holder" is defined as the natural person who is assigned to the designated email account at the email provider associated with the Internet domain name indicated. The decisions of Sponsor are final and binding in all respects.
  6. PUBLICITY: Except where prohibited, participation in this Contest constitutes a winner’s consent to Sponsor’s and its agents’ use of certain information provided by winner for this Contest, including username, name, likeness, photograph, voice, opinions, and/or hometown and state, for promotional purposes in any media, worldwide, without further payment, consideration, or obligation.
  7. CONDITIONS: Sponsor reserves the right to modify or end this Contest at any time. By entering this Contest you represent and warrant that you are 16 years of age or older, or if on behalf of a minor under 16 years of age, are their parent or legal guardian. Prizes are non-transferable and substitution of a prize or exchange for cash will not be permitted except by Sponsor in its sole discretion. ALL EXPENSES, TAXES AND COSTS ASSOCIATED WITH ACCEPTANCE AND USE OF THE PRIZES NOT SET FORTH IN THESE RULES ARE THE OBLIGATION OF THE WINNER. Prize is awarded WITHOUT WARRANTY OF ANY KIND by Sponsor, express or implied, without limitation. By participating in this contest, YOU AGREE THAT SPONSOR AND ALL OF ITS AGENTS, DIRECTORS, OFFICERS, REPRESENTATIVES, AND EMPLOYEES WILL HAVE NO LIABILITY WHATSOEVER FOR ANY INJURIES, DEATH, LOSSES, OR DAMAGES OF ANY KIND, REGARDLESS OF LEGAL THEORY, RESULTING FROM PARTICIPATION IN THIS CONTEST OR ACCEPTANCE, POSSESSION, OR USE OF ANY PRIZE THAT MAY BE AWARDED. Sponsor is not responsible for printing or typographical errors in any Contest-related materials, or for stolen, lost, late, misdirected, damaged, incomplete or illegible entries. If Sponsor determines, in its sole discretion, that there is any suspected or actual electronic tampering with the Contest, or if technical difficulties compromise the integrity of the Contest, Sponsor, in its sole discretion, reserves the right to void any entries submitted fraudulently or cancel or modify the Contest. Any deliberate attempt by an entrant or any other individual to damage any related web site or undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and should such an attempt be made Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor and its agents and providers are not responsible for incorrect entry of information by entrants, or technical malfunctions of any telephone network, computer equipment, software or any combination thereof, entry materials that have been tampered with, human error, or lost/delayed data transmission; or transactions that are processed late or incorrectly or are lost due to computer or electronic malfunction. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  8. LIST OF WINNERS: A list of the winning entrants will be posted at MobilityWare.com/Contests/Macworld2010/Winners.php. The final list will be available on or about Monday, February 15, 2010, with a preliminary list of high-score entrants available on or about Friday, February 12, 2010.
  9. SPONSOR: Upstanding LLC dba MobilityWare, 70 Discovery, Irvine CA 92618, MobilityWare.com, is the sole sponsor and administrator of this Contest. The Sponsor is solely responsible for the delivery of prizes to the winners.
