OFFICIAL "DEATH SPIRAL LAUNCH PARTY" CONTEST RULES

1. CONTEST PERIOD: The entry period for the Death Spiral Launch Party Contest ("Contest") ends at 11:59 P.M. PST on Friday, March 12, 2010. ("Contest Period"). The official time is kept by the computer systems of Aurora Feint Inc., who will be tabulating contest scores
2. ELIGIBILITY: This Contest is open to all individuals with Word Warp Xtreme version 1.1 with Death Spiral mode and a registered OpenFeint user account who are at least 13 years of age on the day of entry. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. This Contest is subject to all applicable federal, state, and local laws and regulations and shall be construed and evaluated only according to the laws of the State of California, United States of America. Employees, officers, directors and agents (and their immediate families and household members) of Sponsor and of Aurora Feint Inc. are not eligible to participate in the Contest
3. ENTRY: You must download Word Warp Xtreme version 1.1 with Death Spiral mode from the iTunes^® App Store. If you have not previously done so, launch your Word Warp Xtreme application, open “Community” and register an OpenFeint user account, following the prompts, with your email address and password. After you are a registered OpenFeint user, play Word Warp Xtreme Death Spiral mode as much as you would like during the Contest Period. Make sure your user account is selected as the active OpenFeint user. Although there are other game modes available for play, only Death Spiral scores are eligible for this Contest.
4. PRIZES: Upon verification of eligibility, entrants with the top ten (10) Death Spiral scores will each win one (1) $15 iTunes^® Gift Card. The entrant with the top Death Spiral score will win one (1) additional iTunes^® Gift Card. Entrants are limited to one eligible top ten score. All entrants are limited to winning one MobilityWare sponsored contest in any consecutive twelve (12) month period. The Approximate Retail Value (“ARV”) of each iTunes^® Gift Card awarded is $15.00. The total ARV is $165.00. Prize winner is responsible for all taxes, fees and costs associated with prize receipt and/or use. Sponsor may substitute a prize of equal or greater value in the event the advertised prize(s) become unavailable. Aurora Feint Inc. is not a sponsor of this Contest in any way. Apple Inc. is not a sponsor of, or associated with, this Contest in any way.
5. AWARDING OF PRIZES: The Sponsor will select potential winners by reviewing the scores tabulated by Aurora Feint Inc. on or about Tuesday, March 16, 2010, then notify potential winners via the email address registered with the entrant’s OpenFeint user account. Participation in this Contest constitutes a potential winner’s consent granting Sponsor permission to request and receive from Aurora Feint Inc. OpenFeint account holder identifying information such as username, email address, and name. In the event a possible winning entrant has multiple scores in the top ten Death Spiral scores, their lower scores will be disregarded in determining other potential winners. To claim a prize, each potential winner must return to Sponsor an Affidavit of Eligibility. If a potential winner cannot be contacted and the prize validly claimed within fourteen (14) days from the first notification attempt, then that potential winner will be disqualified and another potential winner will be selected from the remaining eligible entries. In the event a second potential winner cannot be contacted and prize validly claimed within fourteen (14) days from the first notification attempt to the second individual, that prize will not be awarded for this Contest and the total ARV reduced by the ARV of that prize. In the event of a dispute as to the identity of a potential winner, the potentially winning entry will be declared made by the authorized OpenFeint account holder at the time of entry. An "authorized OpenFeint account holder" is defined as the natural person who is assigned to an OpenFeint user account. The decisions of Sponsor are final and binding in all respects.
6. PUBLICITY: Except where prohibited, participation in this Contest constitutes a winner’s consent to Sponsor’s and its agents’ use of certain information provided by winner for this Contest, including username, name, likeness, photograph, voice, opinions, and/or hometown and state, for promotional purposes in any media, worldwide, without further payment, consideration, or obligation.
7. CONDITIONS: Sponsor reserves the right to modify or end this Contest at any time. By entering this Contest you represent and warrant that you are 13 years of age or older. Prizes are non-transferable and substitution of a prize or exchange for cash will not be permitted except by Sponsor in its sole discretion. ALL EXPENSES, TAXES AND COSTS ASSOCIATED WITH ACCEPTANCE AND USE OF THE PRIZES NOT SET FORTH IN THESE RULES ARE THE OBLIGATION OF THE WINNER. Prize is awarded WITHOUT WARRANTY OF ANY KIND by Sponsor, express or implied, without limitation. By participating in this contest, YOU AGREE THAT SPONSOR AND ALL OF ITS AGENTS, DIRECTORS, OFFICERS, REPRESENTATIVES, AND EMPLOYEES WILL HAVE NO LIABILITY WHATSOEVER FOR ANY INJURIES, DEATH, LOSSES, OR DAMAGES OF ANY KIND, REGARDLESS OF LEGAL THEORY, RESULTING FROM PARTICIPATION IN THIS CONTEST OR ACCEPTANCE, POSSESSION, OR USE OF ANY PRIZE THAT MAY BE AWARDED. Sponsor is not responsible for printing or typographical errors in any Contest-related materials, or for stolen, lost, late, misdirected, damaged, incomplete or illegible entries. If Sponsor determines, in its sole discretion, that there is any suspected or actual electronic tampering with the Contest, or if technical difficulties compromise the integrity of the Contest, Sponsor, in its sole discretion, reserves the right to void any entries submitted fraudulently or cancel or modify the Contest. Any deliberate attempt by an entrant or any other individual to damage any related web site or undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and should such an attempt be made Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor and its agents and providers are not responsible for incorrect entry of information by entrants, or technical malfunctions of any telephone network, computer equipment, software or any combination thereof, entry materials that have been tampered with, human error, or lost/delayed data transmission; or transactions that are processed late or incorrectly or are lost due to computer or electronic malfunction. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
8. LIST OF WINNERS: A list of the winning entrants will be available on or about Tuesday, March 16, 2010, at MobilityWare.com/Contests/WWXLaunchParty/Winners.php.
9. SPONSOR: Upstanding LLC dba MobilityWare, 70 Discovery, Irvine CA 92618, MobilityWare.com, is the sole sponsor and administrator of this Contest. The Sponsor is solely responsible for the delivery of prizes to the winners.
